Introduction

Imagine your children
playing at a public park and you spotted a small aircraft flying around them.
You saw that the flying device has a camera attached to the front and realized
it might have been watching your children. Your first reaction is to get your
children home for safety. While driving you wonder why that thing is hovering
on top of your children. What is that flying object? Are they recording my
children? Is there a sex predator behind those lenses? The device you see is an
unmanned aircraft system and more commonly refer as drone. The scenario mentioned
above is one that numerous people have encounter, or will find themselves in,
as more civilian gets their hands on them.  The purpose of this report is to analyze the current
laws targeting drone user. To recommend plans that will be more effective on
drone activity. Part I of this report will focus on the cost, distribution, and
capacities of drone. Part II discuss about the safety and privacy issue and illegal
incidents that occur with drone activity. Finally, part III explores the
current federal and state laws that pertain to drone activity.

Background

            This
part will provide a brief historical development of unmanned aerial vehicle
(UAS). According to the
Smithsonian
National Air and Space 2017, the production of drone first appears in the early
1900s. The
Kettering Aerial Torpedo (Kettering Bug) was America’s first production of
drone. The Kettering Bug was a miniature biplane constructed to carry a bomb
load equivalent to its own weight of 300 pounds as shown on Figure 1. The Kettering
Bug can attack targets up to 75 miles from its starting point, while traveling
at 50 mile per hour. Despite some successes during initial testing, the
Kettering Bug was never used.
The
United States military ordered copious amount of the Kettering Bug during the last
months of World War I, but when the war ended the orders were cancelled. Further
research indicated that during the late 1980s, the development of drone shifted
from a plan in need of transformation to a weapon that currently played a vital
role in military worldwide. It was the event in 1990 when Iraqi forces invaded
and annexed Kuwait, that gave manufacturer an opportunity to see the potential advantage
of what drone can do. The drone operated at the time demonstrated to be remarkably
worthy by supplying information about opponent’s locations. It was during this
period that the drone technology escalates dramatically (Cash 2017, 701).
